Description of the service:

The territorial divisions of Department of Cultural Heritage under the Ministry of Culture (hereinafter referred to as Department), operating in the territory of declared place of residence (in case of natural person) or of office (in case of legal entity) of owner of movable cultural properties, issue regulations for owners of movable cultural properties and thereby define protection requirements for protection, maintenance, and usage of the property. After including the movable item in the Register of Cultural Properties under the order of Minister of Culture,  the Department shall inform the owner and appropriate territorial division within 5 business days. Upon receiving the notice from Department or application from owner of cultural property, the territorial division shall prepare a regulation not later than within 5 business days and informs the owner by registered post about the time limit of 20 calendar days, during which he must come to the territorial division to take the regulation. The owner of cultural property can take the regulation upon coming to territorial division by himself or through authorized representative.

In order to receive the regulation, the following must be submitted:

1. Application (if there is no notice from territorial division of Department about the prepared regulation);

2. Original identity document of owner of cultural property (natural person) or its notarized copy;

3. Original registration certificate of owner of cultural property (legal entity) or its copy, certified by seal of legal entity (if it must have seal) and by signature of manager;

4. Originals or notarized copies of documents, evidencing the ownership right to the property;

5. Original document, evidencing the representation, original identity document of representative or its notarized copy (if authorized representative of owner of movable cultural properties comes to take regulation).

In cases when regulation is taken by authorized representative of owner of movable cultural properties, whose representation document is issued abroad, this document must be legalized, following the Description of Procedure of Documents Legalization and Certification (Apostille), approved by

Resolution No. 1079, dated 30^th of October, 2006, of the Government of the Republic of Lithuania (Official Gazette, 2006, No. 118-4477).

Description of the service:

The service recipient, wishing to perform management works in the territory of site and (or) protection zone of cultural heritage objects, has the possibility to search, according to immovable cultural property (search is implemented, according to unique code, name, and address of cultural heritage property, registered in the Register of Cultural Properties), the information about the issued permissions (no., permission number, permission date, works permitted, works project, additional requirements for heritage protection).

After including the movable cultural property (hereinafter referred to as property) in the Register of Cultural Properties under the order of Minister of Culture of the Republic of Lithuania,  the Department shall inform the owner of the property, and the territorial division of Department (hereinafter referred to as territorial division),  operating in the territory of declared place of residence (in case of natural person) or of office (in case of legal entity) of owner of the property, and the territorial division, where the property is stored, in writing, not later than within 5 business days. The notice to owner of the property and territorial divisions shall be prepared by Heritage Registry, Public Relations and Education Division of Department. Upon receiving the aforementioned notice, the territorial division fills two passport copies and certifies them with seal within 10 business days. The applications to issue passport shall be accepted, passport shall be filled, replaced, copies shall be issued by territorial division, operating in the territory of declared place of residence (in case of natural person) or of office (in case of legal entity) of owner of the property. A duplicate of the passport is issued, if the original passport is damaged or becomes unsuitable for usage for other reasons. The passport is replaced, if all entries in its form are filled, or the owner of the property submits the passport of form, approved by Order No. 57, dated 3^rd of March, 1999, “Regarding approval of form, provisions and filling rules for passport of movable cultural properties”, if the passport of a new form has not been issued.   

Application must be accompanied by the following:

1. Application;

2. Original identity document of owner of cultural property (natural person) or its notarized copy;

3. Original registration certificate of owner of cultural property (legal entity) or its copy, certified by seal of legal entity (if it must have seal) and by signature of manager;

4. Originals or notarized copies of documents, evidencing the ownership right to the property;

5. Other documents, related with property, which would like to be submitted as annexes to the passport by owner or his authorized person.

Description of the service:

Compensation for owners of movable cultural properties, which are movable items, according to their purpose (hereinafter referred to as properties), shall be granted for expenses of works of inspection, conservation, restoration, and installation of protection measures of movable cultural properties, included in the Register of Cultural Properties (hereinafter referred to as works). Applications shall be considered by 5-member work group, formed upon order of director of Department for two years. Director of Department, taking into account the conclusions and recommendations of Commission, makes final decision on compensation. In case there is a lack of funds for paying compensations to applications, accepted as reasonable by work group, they may be paid in the next calendar year. Application must be accompanied:  

1. Copy of document, evidencing the ownership or other possession rights to property;

2. Copies of documents, evidencing the expenses of works: agreement (s) and estimate (s) with company, installing the protection measures; agreement (s) with person with restorer’s qualification, or with company, employing a certified restorer, together with enclosed estimate (s) of inspection, conservation, restoration works; invoices, payment receipts or bank transfers;

3. Written confirmation that protection measures are installed and operating in the premises, where properties are exhibited, or a copy of acceptance certificate for installed protection measures, prepared under Heritage Management Regulation PTR 3.05.01:2005 “Rules for acceptance of management works of immovable cultural heritage objects”, approved, following the procedure, specified by Order No. ĮV-153, dated 19^th of April, 2005, by Minister of Culture of the Republic of Lithuania “Regarding approval of Heritage Management Regulation PTR 3.05.01:2005 “Rules for acceptance of management works of immovable cultural heritage objects” (in cases when a property is a cultural heritage object);

4. A copy of protocol of Restoration Council, whereby the decision to accept the completed inspection, conservation, restoration works is made;

5. A copy of Power of Attorney, certified, following the procedure, determined by legal acts, if an applicant is represented by other person.

This service provide the people, interested in cultural heritage, with possibility to perform voluntary monitoring of cultural heritage objects by ensuring the possibility to upload the relevant data about cultural heritage objects to Register of Cultural Properties, thus, contributing to preservation of cultural heritage.

The service recipient may leave comments/descriptions at the cultural heritage objects, to upload photos of  cultural heritage objects in the Register of Cultural Properties 

Description of the service:

The service recipient has the possibility:

1. To check whether the permission to perform management works in the territory of site and (or) protection zone of cultural heritage objects is issued;

2. To submit a complaint;

3. To submit other documents, necessary for service provision (e.g., representation-evidencing document; photos regarding possible illegal management works);

4. To obtain information on complaint and receipt of other documents;

5. Track the progress of complaint (e.g., administrative procedure, transfer of complaint to other institution, suspension of administrative procedure, if a complaint on the same issue was started to be considered by court, etc.);

6. To obtain response on the outcome of the ended administrative procedure and made decision, and information on appeal procedure

Description of the service:

The service recipient has the right to make a route in the Register of Cultural Properties for visiting the cultural heritage objects, according to the chosen parameters (e.g., the route to visit wooden churches in Utena district) by choosing certain location and distance, to make a list of objects to be visited in the accuracy of meters.   

Authenticated service recipients have the right to propose for Department of Cultural Heritage under the Ministry of Culture to include their routes to the list of recommended routes.

1. to perform an initial search of written and visual sources with reference to (depictions of) properties, included in the Register of Cultural Properties;

2. to open the chosen sources on the website “epaveldas” (e.g., by clicking on the source link).  

 Authenticated service recipients have the right to:

1. to submit applications for passports of immovable cultural properties, other data extracts, certificates, and other documents from the Register of Cultural Properties;

2. to obtain the requested documents and (or) answers to the inquiries (if decision not to provide information and (or) documents was made, to have the cause of rejection specified).

More information about visiting cultural properties

The owners, possessors of immovable cultural properties, wishing to include their immovable cultural property in the list of cultural heritage objects to be visited, shall submit application to the Department of Cultural Heritage under the Ministry of Culture by specifying the following:  name, address, unique code of cultural heritage object in the Register of Cultural Properties, information on conditions for visiting the cultural heritage objects and their visiting time. If a cultural heritage object has already been included in the list of cultural heritage objects to be visited, the owner, possessor of cultural heritage object is entitled to submit application for update of information about conditions for visiting the cultural heritage objects, visiting time by providing relevant information on the cultural heritage objects. 

Description of the service:

The service recipient has the possibility: 1) To submit inquire for information, regarding activity, functions and administrative services of the Department of Cultural Heritage under the Ministry of Culture (hereinafter referred to as Department); 2) To submit application for consulting within the limits of competence of the Department; 3) To trace the progress of application (e.g., transfer of application to other institution); 3) To obtain replies to inquires and related documents; 4) To receive consulting information and (or) proposal for consulting time and place.

The functions of DCH:

Following Article 6 of Law on Protection of Immovable Cultural Heritage of the Republic of Lithuania, while implementing the assigned tasks, the Department of Cultural Heritage under the Ministry of Culture shall:

6.1. methodically direct the protection of immovable cultural heritage and movable cultural properties, recorded in the Register of Cultural Properties;

6.2. manage the Register of Cultural Properties;

6.3. draft the legal acts on the issues, assigned to the competence of the Department;

6.4. finance:

6.4.1. inclusion of movable items of cultural value in the Register of Cultural Properties;

6.4.2. management works of state-protected immovable cultural heritage works;

6.4.3. inspections, conservation, restoration, installation of protection measures and awareness dissemination of cultural properties as well as properties, which are one of the valuable features of immovable cultural heritage structure, included in the Register of Cultural Properties;

6.5. organize and coordinate the inventory, clarification and monitoring of immovable cultural heritage, proposes the Minister of Culture to include the movable property in the Register of Cultural Properties;

6.6. initiate and organise the declaration of objects of cultural heritage state-protected and submit proposals on the initiation of the declaration of objects of cultural heritage municipality-protected to the heritage protection subdivisions of a municipality;

6.7. conclude protection agreements with owners or possessors of cultural heritage objects, included in the Register of Cultural Properties, and with owners or possessors of land plots or immovable items, located in the territories or protection zones of these objects;  

6.8. submit annual reports on the implementation of the strategic action plan to the State Commission for Cultural Heritage and to the Ministry of Culture;

6.9. draft and issue regulations on the protection of state-protected, objects of cultural heritage, declared as protected by municipality;

6.10. give protection requirements, based on Law on Protection of Immovable Cultural Heritage (Official Gazette, 1995, No. 3-37; 2004, No. 153-5571) and Law on Protection of Movable Cultural Properties (Official Gazette, 1996, No. 14-352; 2008, No. 81-3183), to natural and legal persons;  

6.11. handle complaints, applications and notices, related with protection of cultural heritage objects and movable cultural properties;

6.12. submit judicial facts, related with protection of immovable cultural heritage objects, to manager of Real Estate Register;  

6.13. submit data of legalization or restrictions to use cultural heritage objects as objects of property law for recording or changing to manager of Real Estate Cadastre;

6.14. submit conclusions on whether draft proposals, given by owners or possessors, planning to perform management works of cultural heritage objects, meet the requirements of cultural heritage protection within the time limit, specified by Law on Protection of Immovable Cultural Heritage of the Republic of Lithuania;

6.15. organize and finance the preparation of territorial planning documents, implementing the requirements of Law on Protection of Immovable Cultural Heritage of the Republic of Lithuania;

6.16. check how the Law on Protection of Immovable Cultural Heritage of the Republic of Lithuania, the Law on Protection of Movable Cultural Properties of the Republic of Lithuania, other legal acts, regulating  protection of immovable cultural heritage and movable cultural properties, are implemented, control, whether these legal acts are not violated;  

6.17. administer and control management works of immovable cultural heritage objects, control maintenance works of immovable cultural heritage objects;

6.18. determine the value of losses of damaged immovable cultural properties, and their restoration method;

6.19. determine damage and value of losses for movable cultural properties, included in the Register of Cultural Properties;

6.20. organize certification of natural persons, provided by Law on Protection of Immovable Cultural Heritage of the Republic of Lithuania;  

6.21. within the limits of its competence, perform the functions of entity of environmental impact assessment of economic activity, following the Law on Environmental Impact Assessment of Planned Economic Activity of the Republic of Lithuania (Official Gazette, 1996, No.  82-1965; 2005, No. 84-3105);

6.22. while implementing protection of immovable cultural heritage in reserves and national parks, control:

6.22.1. activity in national reserves, related with heritage protection requirements, identified in Regulations of reserves and territorial planning documents;

6.22.2. how the determined protection and usage regime is followed, how protection and management of cultural heritage objects is ensured, how target programmes are implemented;

6.23. control the course and quality of management works, performed in cultural heritage objects;

6.24. Following the procedure, determined by Law on Protection of Immovable Cultural Heritage of the Republic of Lithuania, organize applied research, obligatory before design of management or during management of cultural heritage objects, when an object is protected by state, and other historical and physical research, required for disclosure of valuable features of immovable cultural heritage objects;  

6.25. issue permissions for destructive research;

6.26. issue permissions to export movable cultural properties and antiques from the Republic of Lithuania;

6.27. prepare, approve, fill and issue passports, regulations of protection of movable cultural properties, included in the Register of Cultural Properties;

6.28. check how regulations of protection of movable cultural properties, included in the Register of Cultural Properties, are followed;

6.29. control how procedure of research, restoration and conservation of  movable cultural properties, included in the Register of Cultural Properties, is followed;

6.30. issue licences to trade antiques, included in the Register of Cultural Properties, or created (made) up to the year of 1800;  

6.31. control how the Rules on Antiques Trade are followed;  

6.32. control how the movable cultural properties, included in Register of Cultural Properties, are followed;

6.33. put forward proposals of legal and natural persons, whose illegal actions made damage, for restoration of condition of immovable cultural properties in the protected objects, their territories or protection zones, which was prior to damage, and to cover all incurred losses to society, and address the court for claiming the damage and recovery of losses; 

6.34. address the court to defend a public interest, regarding collection of movable cultural properties, included in the Register of Cultural Properties, for public needs, recovery of state funds for inspection, restoration, and conservation of these properties, as well as regarding compensation of damage, made due to improper restoration and conservation, or improper protection and usage of  movable cultural properties, included in the Register of Cultural Properties,;

6.35. provide conclusions for organizers of auctions of movable cultural properties and antiques on conditions of export of cultural objects, sold in auctions, from the Republic of Lithuania;  

 6.36. organize valuation of movable cultural properties and antiques, lost or stolen in the Republic of Lithuania, determination of cultural value of antiques, valuation of stolen movable cultural properties or movable cultural properties, illegally exported from the Republic of Lithuania and foreign countries; 

6.37. organize valuation of inherited art antiques, art works, movable cultural properties, organize and perform valuation of inherited antique articles of precious metals and antique gems together with Lithuanian Assay Office, issue the certificate, regarding the value of inherited property, in the form, approved by Ministry of Finance of the Republic of Lithuania;

 6.38. organize and finance the search and return of abroad located cultural objects, significant for Lithuania, preparation of historical review, collect and systemize information on them, organize and finance the release of publications about abroad located cultural objects, significant for Lithuania;

6.39. organize dissemination of knowledge about  immovable cultural heritage and movable cultural properties:

6.39.1. collect, manage, systemize, store and disseminate knowledge about cultural heritage and its protection;

6.39.2. publish information publications, making cultural heritage and its protection more popular, and organize publishing of heritage protection literature;

6.39.3. organize the events, making familiar with cultural heritage and making cultural heritage known;  

6.40. upon assignment of Minister of Culture, represent the Republic of Lithuania in foreign countries or international organizations and events, maintain relationships with appropriate foreign authorities and international organizations within the limits of its competence, following the determined procedure;

6.41. implement the functions of incorporator of institutions, assigned to the field of its regulation;

6.42. manage, use, and dispose the state property in cases, stipulated by laws, and by trust law;

6.43. draw up protocols of administrative violations in cases, stipulated in Code of Administrative Violations of the Republic of Lithuania Official Gazette, 1985, No. 1-1), considers the cases of administrative violations within the limits of its competence;  

6.44. perform other functions specified by Law on Protection of Immovable Cultural Heritage of the Republic of Lithuania, the Law on Protection of Movable Cultural Properties of the Republic of Lithuania, other legal acts, and carry out orders of the Minister of Culture.
